Grandparents’ Rights - Good News For Grandparents’ Rights in Colorado
The Colorado Supreme Court just made it easier for grandparents to visit their grandchildren by stating the child's' best interests should be taken into consideration. The Court's recent decision overturned last year's edict made by the Colorado Court of Appeals that made it virtually impossible for grandparents to visit grandchildren if the parents object.
In reversing the Court of Appeals decision, Supreme Court noted that in adopting the grandparent visitation statute the General Assembly recognized that grandparents often undertake parental type roles in the family. We believe that this decision will make district court judges far more open to granting grandparent visitation, and we cannot underestimate the import of this recent case.
